PERSONAL   PLANNING

After spending your lifetime working hard and looking after others, you may one day need taking care of yourself. The personal planning tools you require are available and can be explained to you by your Notary.

Power of Attorney

- By signing a Power of Attorney, an adult may name a representative to make decisions on the adult’s behalf in relation to financial affairs. An Enduring Power of Attorney may be used when an able-body becomes mentally incompetent due to age, accident, or illness and is unable to make certain legal and financial decisions soundly. In this situation, an attorney may be granted authority to act on behalf on the person granting the Power of Attorney either when the grantor is still capable or has become incapable of making their own decisions.

Representation Agreement

– Representation agreements allow adults to arrange in advance how, when and by whom, decisions about their health care or personal care, the routine management of their financial affairs, or other matters will be made if they become incapable of making decisions independently. This prevents the court appointing someone to make decisions on one’s behalf and allows the individual to arrange in advance how, when and by whom, decisions about their health care or personal care, the routine management of their financial affairs, or other matters will be made.

Advance Directive

- An Advance Directive is a written instruction prepared and signed by a capable adult in advance of a severe illness or injury, which will guide health care providers when providing health care and treatment if the adult is unable to give instructions as to the type of treatment or care someone wants to receive or not receive at the time the health care is required. It is a written statement of a capable adult’s wishes regarding medical treatment, often including a living will, made to ensure those wishes are met.
